In an amicus brief submitted to U.S. District Judge Dale Ho of the Southern District of New York, the former judges—represented by Keker, Van Nest & Peters—urge the court to conduct a factual inquiry to determine whether dismissal is in the public interest and if a quid pro quo has occurred.
